Q. Per the review of 2001 SSO Report, legal concerns were raised regarding the FDD program and private property rights.  What were the actual legal concerns of the SSO  during the formulation of the report in 2001?

A current member of the SSWWE CAC was also a member of thie SSOE Task Force in 2000 and 2001.  What insight could this person bring to this issue?

[CITY] 

The City cannot recreate what ordinances, statutes, regulations and cases were reviewed then, but they would have been the same as what is available for review now – other than any cases decided or laws/regulations adopted since 2001. In any event, city attorney advice to city council and/or other city personnel would be privileged.

Further discussion of these legal issues is not relevant to our mission.  

The team agreed at the last meeting that, for our purposes, we will consider the FDDP to be legal.  

I recommend closing this question.
