Follow up from 8/4/2014 meeting

Regarding the recommendation that mandatory FDD participants should be compensated for on-going costs, Charlie presented the following:

Key issue: this recommendation 
appears to violate rate legislation 
regarding cost of service requirement

It's on page 21 of the presentation.  

I would like city staff to expound on this.  Which legislation are they talking about?

As I recall, Cresson also mentioned this during his presentation on DOM.  He said that utilities can only charge based on the service that is provided.  I would really like some more explanation on this.

It really looks to me like we have neighbors in Churchill Downs and Lansdowne who are getting very different levels of service but paying identical rates.
